It applies exclusively to the availability of marketing services throughout the commitment period, under normal conditions of use, and is designed to ensure service delivery aligned with recognized professional standards — without constituting an absolute performance guarantee or a commitment to specific commercial outcomes. The guarantee issued by Apollon Signature is based on a best-efforts obligation, not an obligation of result. As such, Apollon Signature deploys the reasonable human and technical resources required to maintain the accessibility and continuity of its marketing services, subject to the inherent uncertainties of digital environments, third-party platform changes, updates, and events beyond its control. The client acknowledges that temporary interruptions or limitations may arise without these constituting a contractual breach automatically entitling them to a refund. This guarantee applies strictly subject to full compliance with the General Terms and Conditions and the usage rules established by Apollon Signature. It expressly excludes any failure resulting from improper use of the services, inaccurate information provided by the client, incompatibility with the client's own tools, or a breach of contractual obligations. Where refunds are applicable, the specific conditions are outlined in the relevant sections below and may only be invoked under the circumstances explicitly provided therein.
2. Coverage of the GuaranteeThe guarantee provided by Apollon Signature ensures that the client receives the marketing services included in their subscribed plan, in accordance with the information presented at the time of purchase. It is designed to confirm that services meet the essential characteristics described on the site, within applicable technical and contractual boundaries, for the full duration of the plan. This guarantee is based on a best-efforts obligation. Apollon Signature commits to mobilizing reasonable professional resources to ensure service availability and continuity, subject to temporary interruptions arising from platform changes, updates, technical constraints, or events beyond its control. It does not constitute a guarantee of specific commercial results, nor an assurance of permanent and uninterrupted access to tools and deliverables.
3. Guarantee ConditionsThe guarantee is valid provided the client complies fully with the General Terms and Conditions, uses the services in accordance with their intended purpose, and supplies Apollon Signature with the information, access, and materials necessary for proper service delivery. Any improper, abusive, or fraudulent use, as well as any breach of contractual obligations, results in the immediate forfeiture of guarantee rights, without eligibility for claims or refunds. The guarantee does not cover interruptions, malfunctions, or unmet outcomes resulting from causes external to Apollon Signature, including unilateral changes by third-party platforms, issues related to the client's own tools or infrastructure, inaccurate or incomplete information provided by the client, or maintenance operations required for the proper functioning of the services. In such cases, no compensation or automatic plan extension may be claimed.
4. Guarantee ExclusionsThe guarantee does not cover unmet results, interruptions, or limitations arising from improper use of the services, non-compliance with the General Terms and Conditions, client negligence, or any attempt to circumvent the methods and tools implemented by Apollon Signature. Also excluded are issues resulting from incomplete information provided by the client, incompatibility with their own tools, or failure to validate deliverables within the agreed timeframes. Furthermore, degraded outcomes caused by events beyond Apollon Signature's control — including platform algorithm changes, market shifts, third-party actions, force majeure events, or necessary regulatory developments — are expressly excluded. None of these circumstances give rise to compensation, plan extension, or refund.
5. Refund TermsIn accordance with applicable regulations, the client has a withdrawal right of fourteen (14) days from the date of plan subscription, provided that no service has been fully initiated or delivered during that period. Any withdrawal request must be submitted clearly and unequivocally through the contact methods indicated on the site, and within the legally prescribed timeframes. In the event of a valid withdrawal, Apollon Signature will process the refund of amounts paid — excluding any applicable fees — within a reasonable timeframe upon receipt of the request, using the same payment method as the original transaction, unless otherwise expressly agreed with the client. No refund will be issued beyond the withdrawal period or where services have been materially initiated, delivered, or consumed prior to its expiration. Outside of the statutory withdrawal right, no refund may be claimed — including in cases of dissatisfaction with commercial results, early cancellation at the client's initiative, or access suspension following a breach of the General Terms and Conditions. Any refund request submitted outside the conditions set forth in this section will be automatically declined.
6. Processing TimelinesAll requests relating to service activation, the exercise of withdrawal rights, claims, or refunds are handled by Apollon Signature as promptly as possible upon receipt. Processing times may vary depending on the nature of the request, the verifications required, and applicable technical or administrative constraints. Unless otherwise stated, validly submitted refund requests are processed within a reasonable timeframe in compliance with applicable legal deadlines. Apollon Signature shall not be held liable for any delays resulting from causes beyond its control, including those attributable to payment processors or banking institutions.
7. Request ProcedureAny request relating to the guarantee, the exercise of the withdrawal right, or a potential refund must be submitted in writing by the client through the official contact channels indicated on the Apollon Signature website. The request must be clear, substantiated, and accompanied by all information necessary for its processing — including client identification, the relevant order or plan reference, the subscription date, the precise reason for the request, and any supporting documentation enabling assessment of its eligibility. Incomplete, vague, or requests submitted through unauthorized channels will not be considered and will be automatically declined without obligation to respond. Upon receipt of a complete request, Apollon Signature conducts a preliminary review to verify compliance with the General Terms and Conditions, adherence to applicable deadlines, and the absence of any exclusion grounds. During this review, Apollon Signature reserves the right to request additional information or supporting documents, which must be provided within the specified timeframe; failure to do so will result in the request being considered withdrawn. The final decision — whether favorable or not — is communicated to the client upon completion of the review, and may not be challenged outside the legal remedies provided by law.
8. Special CircumstancesIn certain exceptional situations — including force majeure, major technical incidents, extraordinary maintenance, administrative suspension, confirmed or suspected fraud, or serious breach of the General Terms and Conditions — Apollon Signature reserves the right to adapt, suspend, or decline the application of the guarantee or refund provisions, without the client being entitled to any compensation, refund, or offset. Such situations are assessed on a case-by-case basis, taking into account the prevailing circumstances and available information; any decision made in this context is considered final, subject to mandatory applicable legal provisions.
9. LiabilityApollon Signature shall not be held liable for direct or indirect damages resulting from the client's use of the services, including temporary interruptions, access limitations, technical malfunctions, or outcomes below expectations, where such situations arise from causes beyond its control or from the exclusions set forth herein. Apollon Signature's liability is strictly limited to the delivery of services under the contractual conditions defined, to the exclusion of any guarantee of commercial results or absolute performance. The client acknowledges using the services at their own risk and undertakes to provide accurate, complete, and up-to-date information prior to any subscription. Apollon Signature shall under no circumstances be held responsible for consequences arising from inaccurate information, insufficient client collaboration, improper use of deliverables, or decisions made by the client based on the strategies proposed — nor for any resulting financial losses or indirect damages. In all cases, and to the extent permitted by applicable law, Apollon Signature's total liability shall not exceed the amount actually paid by the client for the plan in question for the current period. No additional compensation, penalties, or damages beyond this cap may be claimed, including in the context of a guarantee claim or refund request.
10. Policy UpdatesApollon Signature reserves the right to modify, adapt, or update these guarantee and refund conditions at any time, particularly in response to legislative, regulatory, or technical developments, or changes to the services offered. Amendments take effect upon publication on the site and apply to requests submitted after that date. It is the client's responsibility to review the current conditions prior to submitting any guarantee or refund request. No amendment shall give rise to additional compensation or refund solely by virtue of its entry into effect; the conditions applicable are those in force at the date of the request.
